The Intellectual property(IP) is the key point in all of this. To make a backup is perfectly fine, as Loony said. And copyrighted torrents are the illegal ones. BTW just recently another torrent site bit the dust, it had to remove ninety five percent of its torrents, as it lost a court case.
That's the risk of uploading backups. Same with downloading, but.... downloading people are harder to hit massively.
