Why flash carts are legal?

    LOL,Ive no sympathy for them companies.Heres my value on things-and bear in mind lower prices could mean more profits due to a vast sales increase.

    Movie-£5 tops
    Music=£5 tops for an album
    Games=£5 for DS , £10 tops for PS3 etc

    If they weren't so overpriced I would of brought way more games and downloaded less roms.
    I wouldn't mind paying more for a great game or great movie, but the definition of great is different for each person.

    Meh. Piracy technicly isn't stealing. Me downloading ROMs doesn't LOSE them any money as I wouldn't have bought the game anyway. The simply do not GAIN anything.

    uugghh.. Downloading pirated software/games/movies is not STEALING. The guy who actually bought the software/game/movie owns the software/game/movie completely, he is aloud to do WHATEVER he wants with it. He decides to upload it and he does, he decides to give you it, so be it, he decides to copy it and give you a copy SO BE IT.

    :p there think of it that way.

    So I guess, owning the Flashcart itself is not illegal, but if the flashcart has a MicroSDCARD filled withed roms makes the Flashcart Illegal? Bc I dont really thing a MicroSDCard can be illegal :D

    Meh. DOwnloading MP3s or any other lossy format could fit through the "lower quality copy" loophole.

    No. Neither the flashcard nor the microsd are illegal, it is the files on the microsd that are illegal. The hardware does not become illegal because it contains illegal software.

    So even if I use the flashcart, technically I wouldn't void my warranty?

    thats an entirely different matter that has nothing to do with the legality of flashcarts.

    WAIT, so then that would mean, If someone had drugs, then the cops would be after them, but if they threw it away during the chase or so, then i guess they would stop chasing him? lol. Bc the illegal stuff is gone.

    No, it means the car they are driving is not illegal even when the drugs are in the car.

    That is bullshit, there is no such law. It is 100% illegal in both cases, no matter how long you have it or whether you own the original.

    So, if you have the actual game, it is legal to have the ROM?

    The actual game card, is not illegal. Since it is produced by the company that made it, and is paid for it.
    Roms however, is the file that contains the game. This is illegal because you're not paying for it and the company created doesn't approve of that.

    This is the reason why Roms have AP's.

    it is legal to produce a rom for your own use (for backup purposes). it is not legal to download one.

    ROM`s are legal, flashcarts are, ROM`s are illegal, when you never owned the downloaded ROM. If you have owned a game, you can legally download ROMs and use them on a flashcart.

    looked it up for ya:

    Downloading roms is legal BUT uploading them NOT.
    Roms were legal but recent with the thing that nintendo signed against flashcard isn't.

    Roms were legal is you remove them after 24 hours.

    It is changing now with the anti-flash and anti-homebrew updates for DSi and WII
