Is it pirating to download a ROM that you don't own whose copyright protection has expired?

So far there seems to be no game whose copyright has already expired as copyrights lasts for 50+ years or so.

What about games whose copyright holders no longer exist? Such as companies who have gone bust?

    Ah yes, the abandonware argument:

Too bad games companies don't like the idea eh?

people who says they can't afford to buy a game actually means that gaming isn't important to them. if it's important, you would make great strides to get it. but you don't, so it's not important.

gas for your car, for instance, people will actually pay money for this thing. what is gas?! it's only used for moving your car. so why are people paying money for this material where it is useless. it is useless because you can't eat it and it serves two things, to move a car or to set things on fire. so why would people pay for gas as opposed to a game. well, some people may say that gas is cheaper, going from about $2-$3 per gallon as opposed to $50-$60. but then again, that $2-$3 dollars is worth nothing as it is not resellable as to the $50-$60 game. you don't have to use your car, there is walking, running, biking, skateboarding, rollerskating, rollerblading, public transportation and even hitchhiking. heck, we can even steal gas from other people. but you don't often see people "pirating" gas from other people, but instead we see people paying for gas.

the wii is the easiest to hack/mod, yet we have games like new mario wii still selling and driving the sales of the wii. look at darkvoid, it's already being sold at $10.

@ultra: As always you give yet another good argument :)

Yes videogaming IS NOT a necessity, rather it is a privilege.

However I kinda have a problem with the analogy you gave. You said Gasoline isn't important when in fact it is, or rather at our current technological level IT IS vital to keep things going.

You see you only focused on "a personal mode of transportation" which is true that it is merely a privilege. But you kinda caved when you added the public transportation bit. The public transportation sector is but one of many other parts of society that needs gasoline & other fossil fuels. You say use public transportation instead of driving your car, but how can public transportation function without fuel? Not only that, the manufacturing sector also needs fossil fuels to run the machines that makes stuff & some like the plastics industry absolutely depends on fossil fuels as plastics are refined from fossil fuel byproducts.

However since you actually nailed the fact that games aren't really a necessity, I still give credit to what you said :)

Now let me again mention one of my time honored arguments LOL!

One major reason why people resort to videogame, music & video piracy is the high cost to purchase said stuff.

    Yes your argument is valid...

"If you want to avail of a privilege you have to work for it."

The problem with this statement is...

"Not everyone has the same monetary value as every country varies in terms of its economy."

Sure 10$ USD may be nothing to you, but there are places in the world where that equals to 100 times or even 10,000 in its value. And, in most cases in third world countries getting 10$USD is not even enough money to last a family for a week. And I'd bet even someone in the U.S. won't last a week with only 10 dollars on them.

I know it's a sick way of justifying a criminal act, but unless games publishers accepts the fact that their games' prices are extremely over the top for poorer countries piracy will never cease to exist.

That depends on what you need your car for.
I need to carry lots of tools with me to work, theres no way i could carry them up to 30 miles a day.
I need my car because my dad is disabled and sometimes needs help.
My car is needed to do shopping and I sometimes have to travel to other citys to buy materials for work.
Theres no way i could get by without a car and so i have to buy fuel.

Gaming is still important to me its my main source of entertainment, i rarely read/watch tv/do anything else in my free time.

Because if I can get something for free rather than pay I will and if they're honest most people would have to admit to the same thing.

Bolded part -> total FAIL, the ESA is one such organization who is taking legal action to halt digital piracy.

Actually, if they were honest, they'd probably not steal in the first place and so would not say the same! ;)

Until they invent something that tracks everything I download and reports it to Nintendo my pirating days will be forever fruitful.
