By reading the warning screens of numerous copied DVDs, (I think) 10 years in prison and/or a 250K$ fine is for the illegal copying, rendering, or distributing them.
Illegal copying = copying DVD's that have that warning in them.

Yes, the firmware had to be decrypted to allow the use of the passboard. Also, the 2i makes use of overwriting memory where the bootloader would generally start, making use of their own source. The debug versions must be purchased for obvious reasons. They are useless to a regular gamer. no$gba makes use of the data generated from GBAtek to make it's own BIOS functions (which is why you may find torrents of it included with real BIOS dumps of the DS). Also, homebrew isn't a problem at all. They would not have their Nitro SDK for open documentation and use, which is what brought the pure asm of the dkARM library, which then brought the creation of higher abstraction. Software created from this is fine, however it's just generally looked down upon, since it gives the idea of using flashcarts etc. in order to test it(they don't release emulator debuggers to the public), see Bob's Game for example. The firmware that acts as a real ROM which can be loaded from the DS firmware simply enables a memory address check valid to make it as loadable as a game (except it's firmware).

Ak2i is the ak 2.1 with a new bootstrap that allows it to boot on the dsi. its holding a bit of actual code which works as the exploit hard coded on the cart itself.

You will notice this big hint when you use AKAIO 1.41, there are only 4 light settings, wow on a DSI when it has 5 light settings... that would mean the loaders are operating in DS mode.

Of course you can always bypass the AKAIO via DSI and use select + volume + or - to adjust to the 5th light setting, which is already hardcoded into DSI Hardware.

Debunking your myth about Flash carts being legal.

Ps. Im sure things will change as soon as someone decrypts an official DSI game cartridge.
