    what about the french Pokemon Heart Gold being released early ?

    it was released last night

    and it's not the owner's fault for buying the game early

    I'm guessing that you guys didn't read the article about the guy who uploaded The New Super Mario Bros. Wii game and was fined 1.5 million dollars by Nintendo did you? Nintendo doesn't go after the downloaders, they go after the uploaders. Why do you think that scene release groups are so damn sneaky and don't release any information? The guy openly bragged about it and got caught plain and simple.

    This still depends on the actual location of the user, in terms of country, and where he brags about it. That was also in Australia, and fines in Australia have absolutely no effect on common law in any other country.

    I doubt the last thing Nintendo wants to do is sue a bunch a kids for ripping a game.. And if they did, they're not gonna do it on a regular basis, simply because of the fact that it's bad for their image...
    I mean seriously...leeching 1.5 million bucks for every kid ripping a silly game?
     
  7. Aeladya - You realize Nintendo was basically doing what the RIAA and other groups like that do all the time? They don't have anything near the resources to track every uploader so they sue one person in a million as a scare tactic.

    But yeah, it's pretty obvious Jermz was just playing everyone here for chumps and he probably got what he wanted. ;P Let's all move on.

    No its not his fault for buying it early, Its his fault is he gets caught upping it to the net. Nintendo will miss out on thousands of sales cause its up for download and they dont like that. They are a business afterall..

    No, they will miss out of thousands of POTENTIAL sales, which are not the same thing.

    No I know they don't have the resources, which is why Nintendo would wait until a major game release to prove their lesson. I'm not saying it will happen, I'm just saying you need to be careful and use things like IP blockers and such, not going around bragging about what you have and what you're doing, because if Nintendo happens to decide to go after you, you're gonna get it.

    if the guy has the game and dumps it then great but if he doesnt have it and is lying then just think about how pathetic and boring his life must be ;)

    A Business maybe.. but their Business is selling games to children and young adults (mostly)
    You don't think they take ripping into account when they release a game?
    Ofcourse they do... Yes do they lose millions, most definitely, but let's be honest here.

    How do you think it will come across to the general audiance if a bunch of 14 year olds get dragged to court by a bunch of cooperate dudes for ripping a nintendo ds game onto the internet.
    They will lose customers that way too...

    I'm not denying that it hasn't happened before... i mean there is proof of that... but really.

    Still wrong. They won't miss out on a single potential sale because pretty much everyone will buy a game worthy of the purchase even if they've already pirated it.

    Rentals and used games do more damage than piracy.

    Not sueing has nothing to do with their image. Everything is ultimately about making money. There is no money in sueing. They can sue all they want, but families that could actually pay those huge fines would not be pirating the game would they? Anyone they sue would not even be able to pay. Think about how much money the CEO's are losing per hour when they go and sue for no real profit. It costs way more than it is worth.

    This coming from the guy who wants some video game so bad, he doesn't care who could possibly get sued because of it.

    Even if someone lies and says they have it and are gonna rip it, i will try to talk them out of it if it's just a random forum poster, Xenophobia and Bahamut probably don't get caught since they know how to be careful most likely. Why do you think they have private sites to release games first? It's so they don't get caught.

    Pokemon, like Mario is a huge release, they most likely would want to protect it more then other games. Maybe.

    Seriously guys, it will get dumped eventually, just wait the 2 days or less
