If you guys haven't noticed, people have already hacked MW2 to have dedicated servers. The game will have dedicated servers, just not hosted directly from IW or Activision. Any other game not supporting dedicated servers will have the same thing going on, dedicated servers will exist, but the devs won't support it.

Also ASD, piracy on the 360 is still rampant, there are people who play the single player for Xbox games. I bet you anything that the people with modded consoles will have two consoles, one for pirated games and one for legit copies. At that point, piracy will be exactly like PC except you have to play around with the hardware.
