Nintendo 3DS under full control of hackers

    No, there never was. The law you are thinking of gives consumers the right to CREATE a backup copy for personal use only. So you can legally dump all your game carts to rom files, and make ISOs of your game discs, but you cannot distribute them or download them.

    The only way the could avoid criminal damages is to pay the people who owned 3DS that bricked, otherwise if nintendo bricks them what loony and i said enters full swing.

    And that law is a bit iffy, since it's of international law, not Local law, so if a country doesnt has it among it's regulations by defacto you are comitting piracy (depends on the specifics of the penal code of each country and what they define as piracy)
