    is god.

So I just found out that you guys have pokemon heartgold and soulsilver roms, and I was wondering how it's possible you got them. It's a full day before their release date in Japan, isn't it? I'm seriously curious about this.

If you look at torrent sites, games usually are released to the internet early. I'm not talking just NDS games, I'm talking Xbox 360, Wii, etc. the usual pre-time on games I see is about 3 days. I don't know how it happens, but a game getting leaked is no uncommon thing. :)

Basically in the time it takes to release the game and ship it the retailers, someone intercepts a copy. Either by being one of the retailers, or similar connections, or through a mistake of the retailer. That person creates a copy of the game, and a group like Xenophobia gets a hold of it by that user. Similar to a few people here who have created ROMs from releases and given them to Seph, who in turn sets them up to the Distro groups.

It all depends on who gets a hold of the games, and whether or not they are able to (ability or knowledge) create a copy of it.

Usually that user is already affiliated with the group, before or current time of the game they're dumping, otherwise it is distributed as a OneUp release if it is individual.
