ok so say I bought an original Star Wars Jedi Knight: Jedi Outcast. But then in an accident, I accidentally lost the disc forever. Will it be legal to re-torrent that game back?

There is a legal grey with Torrents and ROMs that if you own the game you can download the ROM or Torrent the game as a back up copy in case your game gets damaged.

However, as for torrenting for a lost game, I'm not so sure.

so you're saying it won't be legal for me to torrent the game unless I find my lost disc?

    No.

Downloading a game you own is still illegal.

    But...
    Hell yeah!

even if you find your lost disc it would not be legal to torrent it. However, it would be legal to put the disc in a CD burner and make a copy of it, providing the copy is for your own personal use only.

    If it is illegal material.
But if you torrent something like ArchLinux (or other kinds of Linux/Unix), then that is completely legal since it's free for everyone.
