Okay, read the story first, then reply. This has to do with Social Security Disability, and child support. My mom recently started receiving social security because she can no longer work, well, they told her that my dad would have to go the the child support bureau and tell them we get 50% of what she get's, and are to no longer receive child support. He did so. Now 3 months later, she's bitching to me because they're taking the child support out of her check because the child support bureau sent them the court order... Now for the juicy part... My mom is trying to get it worked out with them so she doesn't have to pay child support anymore....And she's saying, that if we don't give her the money back after it's worked out, she's gonna get an attorney and sue. -.- Is she able to do this? And if not, what kinda things can we counter-sue for? Defacement? Behind behind in child support? Anything for her never being there in my life? Feel free to ask questions to offer advice...If she's gonna try this, I need to know if she has a chance of getting the money, and what kinda stuff we can counter-sue for...
lucky you! i am a law student, first tell me your country (it is important) second, check the several codes, if your country has one, check also laws regarding children and work, if you can find PDF's of those it could help. basically for what i get your mother is angry due that the higher ups are cutting a source of income and you are gonna get 50% of whatever sum she gets am i rigth? as i said check those but my best advise get your savings and go to a lawyer of if there are any public ones go to one, he or she should be able to give you a better orientation, but i you live in the US check for similar cases
USA, and I already know about those. She's upset that i'm getting 50% of what she's getting, and that she still has to pay child support. I actually got my dad checking on a lawyer in Kentucky o.0 (I live in Ohio)
the main problem seems really moot, for what i understand you are the beneficied one, i do not know the US regulations ( i live in venezuela) but whatever the laws says is what your mother must do, by this point, if you are still under age i am sure she will still need to pay your support until you are legaly old or so happens mostly in several countries. since i am no expert on the field what your dad did was the best option.
If the child support is court ordered, she can't realistically sue you (or your family) for its return. The courts are the ones that ordered her to pay the money. I would say not to really worry about it, let her waste her time/money trying to find an attorney to take the case. If anything, I'd imagine that her current child support may be adjusted, but meh. Assuming that the child support payments are because of you, then you are still a minor anyway (otherwise she wouldn't be paying child support for you). Sounds like you are just hearing the left overs between your mother and father argue about child support (a very common thing to argue about).
