I'm wondering if the site is having COPYRIGHTs problems.... if so I will not pay for an account..
Many of the games here are still for SALE and available..... I just don`t want to be ripped off again....

    please be honest

the games here are completely free

when you pay for premium, you get access to privileges that normal members don't have, such as faster downloads, more points for downloads

we are not selling games here. By paying for premium you are helping support us and keep the site running, and in return we reward you with more points and faster downloads, as well as removing the adverts. The roms that you have access to do not change.

If there are problems with a specific developer a downloadpage like this will popup:
    https://www.romulation.org/downloads/ProtectedFile/
But that is very rare (I only know about NDS-Games from EA)

Technicly the site lets you download back-ups of your game which you are allowed to own and legaly you are allowed to keep the ROM's on your pc for 24-hours to try and test.meaning that unless they can prove you dont have the real copy of the game they cant do jack

yup, the 'law' allowing you to keep it for 24 hours has no legal weight whatsoever. The only time a rom is legal is when you own the original and you dumped the rom yourself from your own original cartridge, then it falls under 'backup for personal use', which is a right of the consumer in most countries. Or, of course, if it is homebrew.

I'm pretty sure Nintendo has explicitly stated that "backup or archival copies are strictly prohibited".

In any case, the legality of "backups" for any software depends entirely on the terms stipulated in the license agreement, which varies from program to program.

Countries may not allow the EULA to override a consumer's rights as laid out in the laws of the land. It has quite often been the case that companies have used their EULAs to make unreasonable demands of the consumer, thus countries often insist that their laws take precedence of the the terms of an EULA in case of conflict, in order to protect the consumer.

I would think it wiser to resolve such disputes on a case-by-case basis.

I got the manuals to prove that :)

Ok-my advice-don't sell the games you get here (wtf your thinking) online-or anyway-and even if you do get caught (mostly with torrents-thought they almost got me one time) you get a warning to stop-my advice-stop or change stuff like isp...

And all the little tracking stuff they got you with...

And avoid mircro$oft based games and some EA games-those companies seem to know we host thier games and thus warn the site not to...

    Am I right?

(and besides-long aog this site got shut down-but came back-it's not the users who get punshied it's the site that does)

AND finally-when you do "back up games", don't back them up and sell the original..like I do-that's akin to shop lifting even if you owned the game for years XD

(or even if you have the original and download another-that's illegal too-just don't prclaim online I DOWNLOAD GAMES and you shall be fine :) )

or do just dont say it in the real world assuming your country actually has anti-piracy laws

there's no point in the premium. your not losing out on anything.

    your opinion.

also, if i'd donate, it wouldn't be to get more points or to get faster downloads, it would be to give them as a present for their fantastic work and help they give.

And I'm fairly sure Nintendo is a biased source. That's like asking an old man if you can punch him, you will already know the answer.

Well yeah, but I was debunking the claims that backing up your own games is legal.

...Eh, whatever, I'm not going to bother arguing over something I don't really care about.
