I use Diskeeper 2010 and no, I don't get any files that don't defrag.

I think I may do, but they never did much to my pc, so I defrag the drive and leave it as it is.

Even Diskkeeper can't defrag files that are in use. But many defrag programs have a boot time defrag option that can defrag before windows starts up, allowing it full access to all the files.

But the few files in use that won't defrag don't make a huge difference.

I don't really use many files at all at any given time.. When my pc is idle, it runs on 23 - 26 processes, depending on whether I stop some processes that need to be running or not. When not idle I'll be running 29 processes.
