Could RomUlation prevented the ESA attack?

    So i went and checked out a few private servers for WoW and noticed alot of them have an EULA stating that blizzard, its employees, or any of its affiliates cant enter their site and you have to agree to the terms to enter. Could RomUlation have done this to protect itself against the ESA? or is there a bunch of loopholes that i dont know about?

    That's like an agreement between the software holder and the company that they won't do anything that is against the rules. Like when you joined RomU except there isn't any software there.

    Roms are illegal unlike purchased software and this couldn't have been prevented unless roms were freeware.

    Or something along those lines. :p

    EULA's aren't really legally binding. They wouldn't hold up against Blizzard shutting them down if they so cared to. You can't make illegal activities legal just by saying "Hey! If you catch me, then you can't prosecute me!". It doesn't work that way.
